From me at JST Workout, thank you for using this web app! It was built to help you in your training journey and achieve your best results. These Terms of Service were created to help keep things sailing smoothly and make sure every user understands the ins and outs of what is being provided.

When we say "JST Workout", "Website", "we", "our", or "us" in this document, we are referring to this website, JST Workout, which is independently owned and operated by a single developer. While JST Workout is not formally registered as a company, it operates as a personal project and is not affiliated with any separate legal entities.

When we say "Services" or "App", we mean this website and the features and functionalities provided by it, delivered within a web browser on desktop, mobile, or other devices.

When we say "You" or "your", we are referring to the people that own an account with JST Workout.

We may update these Terms of Service ("Terms") in the future. Whenever we make a significant change in our policies, we will refresh the date at the top of this page and take any other appropriate steps to notify account holders.

When you use our Services, now or in the future, you are agreeing to the latest Terms. There may be times where we do not exercise or enforce a right or provision of the Terms; however, that does not mean we are waiving that right or provision. These Terms do contain a limitation of our liability.

If you violate any of the Terms, we may terminate your account. We reserve the right to terminate your account for any reason should you be performing an actions deemed to be in bad faith.

Account Terms

You are responsible for maintaining the security of you account and password. We cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. We recommend all users create a strong, unique password for any accounts made with the Website and do not share it with anyone else.
You may not use the Services for any purposes that could be deemed malicious or being performed with bad intent.
You are responsible for all content saved to and shared from your account.
You must be a human. Accounts registered or operated by "bots" or other automated methods are not permitted.

Payments, Refunds, and Plan Changes

Payments are optional and not required to access the website. However, some features and Services may be unavailable for non-paying users. Payments are recurring subscriptions offered on a monthly, six-monthly, or annual billing cycle.
Payments and all related information regarding your payments, are hosted and stored by our payment provider Stripe.
Once signing up, you are entitled to a free trial of our App. We do not ask you for your credit card or any payment information and — just like customers who pay for our Services — we do not sell your data. The length/details of the free trial are given in a FAQ that will appear anywhere that outlines details of paid Services. After the trial period, you do not need to pay to keep using the App, however some Services may be unavailable for use.
If you are upgrading to a paid plan, you will be charged immediately and your billing cycle begins on the day of the upgrade. Access to paid Services will be given as soon as payment is confirmed.
When upgrading payment plans, the difference between the upgraded plan and your current plan will be charged to you, preserving your billing cycle date.
Refunds are processed on a case-by-case basis. The likelihood of you receiving a refund may vary depending on account usage, extenuating circumstances, and how respectful you are.

Cancellation and Termination

You are solely responsible for properly canceling your account. Within your account details section of the profile page will be a simple no-questions-asked cancellation link. This will terminate both your account with us and our payment provider, should you have provided information for a paid membership. An email request to cancel your account is not automatically considered cancellation but we will do our best to help you should there be any need for it. Requests can be made at support@jst-workout.com.
All of your content will be permanently deleted from our storage and inaccessible from the Website immediately upon account cancellation. We cannot recover this information once it has been permanently deleted.
Cancellation of paid Services will take effect at the end of your current billing cycle, and you will no longer be charged any recurring payments. You will be able to continue to use these Services until that time. We do not automatically and retroactively prorate any unused time in the last billing cycle.
We have the right to suspend or terminate your account and refuse any and all current or future use of our Services for any reason at any time. Suspension means you and will not be able to access your account or any content in your account. We also reserve the right to refuse the use of the App to anyone for any reason at any time. We have this clause because, out of the many potential users of JST Workout, there is a probability of at least someone doing something nefarious. The best way to avoid that person being you is to do good and do not go out of your way to act in bad faith.
Verbal, physical, written, or other abuse (including threats of abuse or retribution) of anyone operating the Website will result in immediate account termination.

Modifications to the App and Prices

We will do our best to maintain our App and its Services for as long as is feasibly possible. That means when it comes to security, privacy, and customer support, we will continue to maintain any legacy services. Sometimes it becomes technically impossible to continue a feature or we redesign a part of our App because we think it could be better. We reserve the right at any time to modify or discontinue, temporarily or permanently, any part of our Services with or without notice.
Sometimes we change the pricing structure for our products. When we do that, we will tend to exempt existing customers with recurring payments from those changes. However, we may choose to change the prices for existing customers. If we do so, we will give at least 30 days notice and will attempt notify you appropriately.

Uptime, Security, and Privacy

Your use of the Services is at your sole risk. We provide these Services on an "as is" and "as available" basis. We do not offer service-level agreements for our Services, but do attempt to take uptime of our Website seriously.
We reserve the right to temporarily or permanently disable your account if your usage significantly exceeds the average usage of other users of the Website. We will attempt to reach out to the account owner before taking any action except in rare cases where the level of use may negatively impact the performance of the App for other users.
We take measures to protect and secure your stored data through encryption, such as in the case of password storage. When you use our App, you entrust us with your data. You agree that JST Workout may process your data as described in our Privacy Policy and for no other purpose. We as humans can access your data for the following reasons:
- To help you with support requests you make. We will ask for express consent before accessing your account.
- On rare occasions when an error occurs that stops an automated process or Service from functioning.
We use third party vendors and hosting services to provide the necessary hardware, software, networking, storage, and related technology required to run JST Workout and its Services. You can see a list of all subprocessors who handle personal data in our Privacy Policy.

Copyright and Content Ownership

All content created and saved on the App must comply with UK copyright law.
You give us a limited license to use the content posted by you in order to provide the Services to you, but we claim no ownership rights over those materials.
We do not pre-screen content, but we reserve the right (but no the obligation) in our sole discretion to refuse or remove any content that is available via the App.
JST Workout owns all rights, titles, and interests in and to the App, including all intellectual property rights therein, and you obtain no ownership rights in the App or its Services as a result of your use. You may not duplicate, copy, or reuse any portion of the HTML, CSS, or JavaScript without express written permission from JST Workout. You must request permission to use the Website'slogos for promotional purposes. Please contact us for any enquiries. We reserve the right to rescind any permissions if you violate these Terms.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the App, use of its Services, or access to the Services without express written permission of JST Workout.

Features and Bugs

JST Workout has been designed and created with care, based on what we think will work best for what we wish to provide. However, there is no such thing as a service that pleases everybody. We make no guarantees that our Services will meet your specific requirements or expectations.

We all test all of our features extensively before shipping them, wherein Services will be provided to users as is. As with any software, our Services inevitably have some bugs. We track the bugs reported to us and work through priority ones, especially any related to security or privacy. Not all reported bugs will get fixed and we don't guarantee completely error-free Services. Please report any bugs found by contacting us.

The information provided on the Website and its associated Services is for general information purposes only. It is not intended as a substitute for professional medical advice, diagnosis, or treatment. Reliance on any information provided by JST Workout, its employees, or others appearing on the website or within the services is solely at your own risk. JST Workout is not responsible for any health problems that may result from consulting the information provided on this site or from its Services.

By using the Website and its Services, you acknowledge and agree to this medical disclaimer. If you do not agree to this disclaimer, please refrain from using the Website and its Services.

Liability

We mention liability through these Terms, but to put it all in one section:

You expressly understand and agree that JST Workout shall not be liable, in law or in equity, to you or to any third party for any direct, indirect, incidental, lost profits, special, consequential, punitive or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if we have been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the Services; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into, through, or from the Services; (iii) unauthorised access to or alteration of your transmissions or data; (iv) statements or conduct of any third part on the service; (v) or any other matter relating to these Terms of the Services, whether as a breach of contract, tort (including negligence whether active or passive), or any other theory of liability.
